Wrongful Death

 

There is nothing more tragic than losing a loved one through accident or medical misadventure. There are many causes of death through injury. When it is believed that death should have been preventable and was caused through negligence a family has the right to seek compensation. Of course it can never bring back the life that was lost but it can not only help pay costs but also help to bring a sense of understanding and closure.

Some examples of common kinds of wrongful death that are pursued include the following:

  • Construction accidents – can occur for a number of reasons. Sometimes they are caused by falls, but often faulty equipment is found to be blamed. Machinery that breaks down or collapses. Poor materials or safety equipment can also be causes of accidents on construction sites along with miscommunication. Companies who provide unsafe working conditions are liable for any wrongful death that may occur.
  • Airplane crashes – lawsuits involving airplane or helicopter accidents can be very complex. Inquiries and findings into the cause of aviation crashes can be lengthy and usually involve many people and agencies.
  • Accidents involving auto traffic – unfortunately these tragedies occur on a daily basis. Sometimes liability is clear but more often than not a lengthy battle can evolve to find out who is responsible and to what degree. Accidents involving young people and/or alcohol and drugs are unfortunately still on the rise in many areas.
  • Premises Liability – Deaths that occur while legally on someone else’s property that was unsafe. Depending on the circumstances of death the property owner may or may not be found at fault. If they were aware of an unsafe environment and had neglected to correct it they will be held responsible for causing that death.
  • Daycare injuries – perhaps the saddest of all as they involve children. Most daycares are under strict regulations to provide a safe environment. Some cases may involve inadequate supervision, safety of equipment used, or proper security.
  • Medical malpractice – this is perhaps one of the most common types of wrongful death cases that are pursued. Losing a loved one who you believed to be in safe medical hands can be devastating. While some medical malpractice suits involve just one person others can bring entire hospital under liability.

Whatever the situation in which someone dies accidentally it is important for the family to contact a lawyer as soon as possible. This can be hard to do in the midst of funeral arrangements and grieving, but is often worth the pain in the long run.
